Murder accused had firearms residue on hand, trial hears

Summary

During a Central Criminal Court hearing on 29 February 2016, Gary Flynn, aged 31, pleaded not guilty to the murder of Seamus 'Shay' O'Byrne, which occurred on 13 March 2009 at Tymon Park North, Tallaght. An expert, Liam Fleury of the Forensic Science Laboratory, testified that he found firearms residue on Flynn's right hand and on the cuffs of a grey hoodie that Gardaí said belonged to him. No residue was found on Flynn's face or left hand. Fleury explained that such residue is emitted when a gun is fired and can adhere to the shooter's skin and clothing. He had not examined any evidence relating to Garrett O'Brien, who the prosecution claims was the actual shooter and has already been convicted of the murder. Detective Garda Shane Farrell reported finding fingerprints on a Nissan Primera bonnet, one belonging to Eugene Cullen and another to Flynn.
