A man matching Flynn's description exited the vehicle, wearing a grey tracksuit and white runners, and entered the garage. Further CCTV from a homeowner's system in Tymon Park displayed a saloon‑type car, possibly a Nissan Primera, arriving before five shots were fired and then leaving the estate. Flynn pleaded not guilty, and the trial was set to continue before Justice Patrick McCarthy and a jury of nine men and three women. The prosecution argued that the same case was being made against Flynn as for another suspect, Eugene Cullen.
