In a 2016 Central Criminal Court hearing, Garda Detective Michael McGrath presented CCTV evidence linking 31‑year‑old Gary Flynn of Rossfield Drive, Tallaght, to the scene of the fatal shooting of Seamus 'Shay' O'Byrne at Tymon Park North on 13 March 2009. The footage showed a Nissan Primera with a defective headlight stopping at a Topaz garage on Forfield Road about 90 minutes before the shooting. A man matching Flynn's description exited the vehicle, wearing a grey tracksuit and white runners, and entered the garage. Further CCTV from a homeowner's system in Tymon Park displayed a saloon‑type car, possibly a Nissan Primera, arriving before five shots were fired and then leaving the estate. Flynn pleaded not guilty, and the trial was set to continue before Justice Patrick McCarthy and a jury of nine men and three women. The prosecution argued that the same case was being made against Flynn as for another suspect, Eugene Cullen.
