Ballsbridge trespass case dismissed after State fails to establish required evidence

Summary

A charge of trespassing against Mohammed Bishet (30), of no fixed abode, has been dismissed after a judge found the State had failed to establish the required evidence. Gardaí responded to a call at the property and found the front-door lock broken and the door open. A light was on upstairs, and two males were spotted. Bishet was cautioned and taken to Irishtown Garda Station, where he was later charged. Defence counsel, Silvia Maria Crowley BL, argued that the prosecution had failed to establish lack of consent from the owner or occupier, a core requirement under the law. She noted there was no evidence that Bishet had broken the lock or caused damage.
