Summary
A plasterer has been awarded nearly €17,000 in compensation after his employer, Kenplast Ltd, was found to have breached construction industry pay rules. The Workplace Relations Commission (WRC) ruled that the company had failed to comply with the Industrial Relations (Amendment) Act 2015 and the Terms of Employment (Information) Act 1994. Joseph Lennon discovered a discrepancy between his pay and the figures on his Revenue account and sought help from an accountant. The company's accountant initially assured him there was no issue, but Lennon engaged his own accountant, who found inconsistencies. The tribunal heard that the company had not provided sufficient information on payslips and had not met the minimum hourly rate set by the Sectoral Employment Order (Construction Sector) 2023. Adjudicator Kara Turner found that the company had failed to provide a written statement of employment terms and had not implemented necessary benefits such as a pension scheme or sick pay. The total compensation awarded was €16,940.
