Shop worker convicted of flashing genitals to Nutgrove customer

Summary

Brian Carroll, 30, of South Circular Road, Dublin 8, was convicted at Tallaght District Court of exposing his genitals to a customer at Nutgrove Shopping Centre on 28 June 2023. The offence, contrary to section 45 of the Criminal Law (Sexual Offences) Act 2017, was alleged to have occurred when the woman returned to a Three mobile phone store for a follow-up. She testified that Carroll asked her to move around the counter to view an iPad screen, during which she saw his erect penis. Carroll pleaded not guilty, denying the incident occurred and stating he was wearing shorts and a branded T-shirt. He argued there was no possible way the complainant could have seen anything from her position. Defence counsel Seoirse Fennessy BL argued there was no evidence of intent to cause fear or distress, noting Carroll's cooperation in attempting to retrieve CCTV footage, which was unavailable due to a full hard drive. The prosecution contended that intent could be inferred from Carroll's actions. Judge Patricia McNamara found the complainant credible and satisfied to convict Carroll. The matter was adjourned to allow the woman to prepare a victim impact report and for a pre-sentencing probation report to assess Carroll's risk of reoffending. The judge warned Carroll not to come to the attention of Gardaí in the meantime. The case was put back for sentencing on 19 February.
