Summary

Professor Marie Cassidy, State Pathologist, gave evidence at the Central Criminal Court regarding the murder of Seamus 'Shay' O'Byrne, who was shot five times on 13 March 2009 at Tymon Park North, Tallaght. She described the bullet wounds: one in the head, two in the back, one in the right shoulder and one in the left thigh. The wounds to the torso caused extensive bleeding and damaged the lungs and heart, leading to death. The head wound caused bruising to the brain surface, while the hip wound was a superficial flesh injury. Cassidy noted that the hip bullet might also have injured Sharon Rattigan, who was shot when she tried to wrestle the gun. She could not determine if all bullets came from the same gun. Garda evidence included swabs and fingerprints taken from Gary Flynn, the accused, by Sergeant Ciaran Loughrey and Garda Declan Claffey. The trial continues before a jury and Justice Patrick McCarthy. Gary Flynn pleaded not guilty.
