Murder accused stopped in car shortly after shooting, court hears

Summary

Gary Flynn, aged 31, was arrested in a silver Nissan Primera shortly after the March 13, 2009 shooting that killed Seamus 'Shay' O'Byrne at Tymon Park North, Tallaght. Detective Garda Mary Moore, of the NBCI, stopped the car in Kimmage, noting it matched the description of a vehicle the Gardaí were seeking. She reported that Flynn was seated in the front passenger seat and that three people were inside the vehicle. Flynn was handcuffed and evidence bags were placed over his hands to preserve any firearm residue. Garda Alan Curry examined the car, noting it lacked a tax disk, had an out‑of‑date NCT, and contained a mobile phone and McDonald's wrappers. Additional evidence was seized from a Ford Transit van, including a mismatched chassis number and fingerprints. The case is pending before Justice Patrick McCarthy and a jury. Gary Flynn pleaded not guilty.
