Summary

In the Central Criminal Court, State lawyers argued that Gary Flynn, 31, of Rossfield Drive, Tallaght, was a member of a "murder gang" that planned and carried out the killing of Seamus 'Shay' O'Byrne at Tymon Park North on 13 March 2009. Prosecutor Alex Owens SC told the jury that the gang met at Moran's Hotel on Naas Road, travelled to Tallaght in three vehicles—a Nissan Primera, a Volkswagen Golf and a Mercedes Van—and left around 7.30 pm. At about 8.15 pm, a gang member shot O'Byrne, was tackled by Sharon Rattigan who was waiting outside, and the shooter fell over a wall, separating from the rest of the gang. Rattigan was wounded in the leg. Owens said the shooter returned alone to Moran's Hotel, and that Flynn's membership and involvement in the common design to murder O'Byrne were central to the State's case. Flynn pleaded not guilty.
