Summary
A 16‑year‑old Transition Year student won €9,000 compensation after the Workplace Relations Commission found his school's uniform rule indirectly discriminated against him on gender grounds. The rule required ear piercings to be worn in pairs, effectively allowing only one stud for girls but two for boys. The student had a single stud in his left ear, which the school deemed a breach of its code of behaviour. He was subjected to sanctions such as sitting outside the principal's office, denied leave to go to town on lunch break, and assigned to evening detention. The tribunal ruled these sanctions were disproportionate and amounted to victimisation because they arose solely from his objection to the discriminatory rule. The school was ordered to amend its policy to allow one or two earrings and to pay the compensation, to be held in trust until the student turns 18 for his education. The decision was published anonymously.
