Summary
In a case heard by the Workplace Relations Commission, Omar Mohammed Osman, a night manager at Cantarini Limited's City Quay aparthotel, was dismissed after allegations that he bullied a gay colleague, Mr D, for his sexuality. Mr D claimed Osman called him "a big homosexual" and "princess", whistled at him and mocked his accent. Osman denied the allegations, stating he had no issue with homosexuals and that the nickname referred to a female colleague. The tribunal found Osman had been "bullying and harassing a colleague in relation to their sexual orientation and race" and dismissed him. Osman later emailed the HR manager to appeal the dismissal, but the email was not responded to because the recipient had left the company. The WRC ruled that while the dismissal was reasonable, the failure to allow Osman to appeal made it an unfair dismissal, awarding him €3,000 in compensation. The case did not find any protected disclosure or safety‑related claims.
