Summary

During the trial of a Kerry man accused of raping a sex worker in a Dublin hotel room on 28 March 2010, evidence was presented that semen found at the scene belonged to two unknown men. The accused pleaded not guilty to oral rape and sexual assault, and denied two counts of threatening a witness in a Garda investigation between 29 April and 28 May 2010. Forensic scientist Michael Burlington extracted DNA from semen samples recovered from a sink in the hotel room, which did not match the accused's DNA profile; this profile was labelled "unknown one". The woman testified that the accused ejaculated into her mouth, after which she spat the semen into the sink and wiped her mouth with a towel. DNA from the towel yielded a second unknown profile, labelled "unknown two", which could not be ruled out as the source.
