Ex-tech company staff win €45k for non-payment of salary, constructive dismissal

Summary
Two former Cleandata Limited employees, Anoushka Anilkumar Parmar and Tushar Joshi, won over €45,000 after a Workplace Relations Commission hearing in December 2023. They had quit in June 2022 after receiving only €2,000 in wages between January and June 2022, far below the €2,500 monthly salary they were entitled to. Parmar was owed €10,500 and Joshi €14,500 in back wages. Both claimed constructive dismissal, having handed in notice on 3 June 2022 and waiting more than six months to lodge claims because the former CEO promised re‑employment and relocation to France. The WRC found Cleandata breached the Payment of Wages Act 1991 and the Unfair Dismissals Act 1977. Parmar received €2,500 in compensation for four weeks' wages, while Joshi was awarded €18,288 for loss of earnings. The total awarded against Cleandata was €45,788. Further Employment Equality Act complaints were not pursued.

Why: Giving evidence on statutory complaints under the Unfair Dismissals Act 1977 and the Payment of Wages Act 1991, the workers explained that Cleandata had "gone through financial difficulties in the past" which had impacted their salaries. CNI source report
