Man who defiled teen in State care is jailed for two years
Summary
Sean Downes, 40, pleaded guilty to one count of defilement of a child under 17 at a Dublin address in April 2021. The victim, a 16‑year‑old non‑binary teenager under State care, was intoxicated and later reported the assault. Forensic DNA matched the teenager to a sample from Downes' boxer shorts. Downes had 23 prior convictions. Mr Justice David Keane set a headline sentence of five years, reduced to four years, and suspended the final two years. He imposed a two‑year post‑release supervision order, requiring engagement with the Probation Service and any suitable treatment programmes. The teenager read a victim impact statement, expressing ongoing distress and a desire for the pronoun "he." Downes was ordered to comply with the supervision order and treatment requirements. The case remains at the sentencing stage.
