Bus driver won't receive compensation over test that took him off road

Summary

A bus driver who claimed he was misdiagnosed with a heart condition and taken off the road by his employer's medical department will not receive compensation. The Workplace Relations Commission found the public transport company did not act unfairly, but urged it to give the driver extra paid leave days after he argued that a faulty cardiac test used up his sick pay. The driver, represented by the National Bus and Rail Union, said the ECG on 15 November 2022 had sensor difficulties and that he was told he had suffered a cardiac event, which shocked him and his family. He was taken off work, used up his paid sick leave, and returned to driving on 10 December after a second, clear ECG at a private clinic. The company maintained that its fitness-to-work assessments were reasonable and applied uniformly.
