Summary
In a case heard by the Workplace Relations Commission, former Twitter executive Robert Talbot sought €13,000 in unpaid statutory annual leave from Twitter International Unlimited Company. Talbot had agreed in May to take redundancy from his €167,000‑a‑year role in exchange for an ex‑gratia payment of €73,000. He claimed Twitter failed to pay €12,883 for unused leave accrued in 2022. Twitter's counsel, Mark Curran BL, argued the claim was a private contractual matter outside the WRC's jurisdiction, noting Talbot had waived his right to an employment rights claim by signing the ex‑gratia agreement. The adjudicator, Elizabeth Spelman, held that severance agreements must inform workers of their rights and that consent must be informed. She found Talbot had signed with informed consent and therefore the WRC had no jurisdiction to hear the claim.
