Murder accused seen with knife before stabbing, jury hears

Summary

In the trial of Andrew Gibney, 21, the court heard that he was seen with a knife before the stabbing of Gerard Burnett, 28, on 21 August 2012. A statement from Lee Dalton, who was drinking with a group of five men that night, was read by Mr Tom O'Connell SC. Dalton said the men had gone to Burnett's house to buy alcohol and that Gibney had taken a knife with a silver blade and silver handle to use if Burnett "got smart". Dalton also said he did not want to go with them and that he had been told by Gibney that he had no bad feelings toward Burnett. During cross‑examination, Detective Garda Tom Cooney confirmed that Dalton had seen a thick silver‑bladed knife and that he had seen four knives, one of which looked like the knife in Gibney's kitchen. Andrew Gibney pleaded not guilty.
