Summary

The trial of three former Anglo Irish Bank officials accused of hiding accounts connected to former chairman Sean FitzPatrick in an alleged tax evasion scheme has been adjourned. Judge Patrick McCartan excused the jury until next Monday to allow for legal argument, stating they were removed to avoid being 'infected' with material that does not constitute evidence. The accused are Bernard Daly, 65, of Whitehall, Dublin; Tiarnan O'Mahoney, 54, of Enniskerry, Co. Wicklow; and Aoife Maguire, 60, of Kilmainham, Dublin. All three pleaded not guilty to seven alleged offences committed in 2003 and 2004. They are accused of archiving and hiding off-shore accounts that may have had Deposit Interest Retention Tax owed on them. Specifically, the three are accused of trying to delete references to two accounts in the name of John Peter O'Toole, Mr FitzPatrick's brother-in-law, from Anglo's Core Banking System. Mr Daly and Mr O'Mahoney also deny omitting Mr O'Toole's name from a list provided to the Revenue Commissioners regarding non-resident accounts worth more than €100,000 in 1995. Additionally, Mr O'Mahoney and Ms Maguire deny attempting to delete six other accounts connected to Mr FitzPatrick from the system. The matter was adjourned, with evidence to continue next week.
