Summary
Krzysztof Cender, a worker for Onsite Facilities Management Ltd since March 2007, was awarded €16,692 in compensation after the Workplace Relations Commission found that the company had failed to pay him a Sunday premium for over thirteen years. Cender had worked every Sunday as part of his routine but had not received any extra pay. He first raised the issue in 2014 with director Catherine Leen and an HR officer, who told him he was not entitled to a premium. No reference to a Sunday premium appeared in any subsequent correspondence. The company admitted the omission was an oversight and rectified it in April 2022, after Cender lodged a complaint. The adjudicator ruled that the employer had an ongoing duty to compensate employees working Sundays, and awarded Cender six months' pay, with the company ordered to update its contract to include the premium clause by mid‑February.
