Lab analyst who claimed he was 'ambushed' during investigation loses constructive dismissal claim

Summary

Michael Molumby, a lab analyst at Pinewood Healthcare Laboratories, claimed that investigators, including former Garda detective Kevin Sweeney and former regulator Stan O'Neill, ambushed him during a data audit in summer 2020, alleging intimidation and blackmail. He said the interview was hostile, that he was offered an amnesty that felt like blackmail, and that he left without signing a notepad. Molumby argued the investigation was humiliating and an assault on his good name. The Workplace Relations Commission found no evidence of intimidation or harassment, no threat to his job, and that his resignation in September 2020 was within his rights.
