Motor dealer employee unfairly sacked after MD accused of telling him to 'f**k off'

Summary

During a heated dispute over warranty paperwork at JJ Fleming & Co on 15 February, service manager Cyril Murray was shouted at by managing director Pat Fleming, who allegedly told him to "f**k off" and "bring the f**king van back in the morning." Murray claimed the remarks implied dismissal, left the office, and later filed an unfair dismissal complaint. The Workplace Relations Commission found that the company had terminated his employment without fair procedures, ruling that the dismissal was not voluntary. The tribunal noted that Fleming used profanity regularly and that the exchange was heated, with no attempt by the employer to re‑engage or apply proper dismissal protocols. Murray was awarded €2,700 in compensation, equivalent to three weeks' pay, for the unfair dismissal. The decision upheld the complaint under the Unfair Dismissals Act 1977.
