No jail for pair who took part in violent group attack on garda
Summary
In a Dublin Circuit Criminal Court hearing on 25 October 2022, two teenagers, Clayton Mulhall (23) and Daryl Donnery (21), were found guilty of violent disorder and assault after a 2018 attack on a patrol garda. The incident involved the youths blocking a patrol garda's path, punching him, and using pepper spray. Mulhall struck the garda's face, while Donnery was later found in possession of MDMA. Both pleaded guilty to violent disorder; Donnery was acquitted of assault. Mulhall also pleaded guilty to assault causing harm, and Donnery pleaded not guilty to that charge. The court imposed fully suspended prison sentences: Mulhall received a three‑and‑a‑half‑year term suspended on conditions including probation, drug‑free status, and payment of €800 to the passerby whose bike he stole; Donnery received a four‑year term suspended on two years of probation. The judge noted the seriousness of the attack, the garda's injuries, and the defendants' remorse and prior convictions.
