Majority jury convicts man of sex assault on sleeping woman

Summary

In a Central Criminal Court trial, a 38‑year‑old man was found guilty by a majority jury of sexually assaulting a woman while she slept. The defendant had pleaded not guilty to sexual assault at a south Dublin location on the early morning of 13 May 2018. The complainant, who was with a roommate, met the defendant at a city centre pub on 12 May 2018 and later at his home. After initial kissing and a conversation, they moved to his bedroom where the defendant digitally penetrated her and performed oral sex. She refused to perform oral sex on him and he demanded ejaculation inside her. She fell asleep, woke to find him on top of her and groping her breasts, and told him to stop. She stated she had not consented to any activity while asleep. The jury deliberated for just under eight and a half hours before returning a guilty verdict.
