The victim, who was sleeping, allegedly woke to find the accused on top of her, groping her breasts, and later again on top of her engaging in sexual activity. She claimed she resisted, pushed him off, and said the act amounted to rape. The accused allegedly apologized, claimed drunkenness, and said he was ashamed.
