Charges upgraded to murder after death of Barry Wolverson

Summary

In March 2022 the Special Criminal Court accepted jurisdiction to hear the cases of Bernard Fogarty, 34, and Robert Redmond, 33, who were originally charged with attempted murder of Barry Wolverston. Wolverston died in hospital on 21 February 2021 after a long illness. The State solicitor applied for the charges to be upgraded to murder under Section 49 of the Offences Against the State Act, and the court agreed. The attempted murder charges were withdrawn and replaced by murder charges. Both men were also charged with assault causing harm to Gerard Wildman, and with possession of a .38/.357 calibre firearm and ammunition with intent to endanger life or cause serious injury. The original trial date of 15 June 2022 was retained. Both defendants confirmed their names in court and were served with the Book of Evidence. The case is now set to proceed under the new murder charges.
