'Excessive self-defence' case sees man avoid jail for bar assault

Summary

Barry Doyle, 40, was sentenced by Judge Karen O'Connor to a fully suspended 12‑month imprisonment for assault causing harm after he threw Stephen Bradley to the ground and kicked him in the Beacon Hotel bar, Sandyford, on 17 December 2018. Doyle repeatedly offered Bradley a drink, which Bradley declined, and when Bradley tried to stop the offers he showed a pricey whiskey on his phone. Doyle threw the phone back, threatened Bradley, and when Bradley walked into the kitchen and grabbed a ladle, Doyle and a friend tackled him, kicking until staff intervened. Doyle pleaded guilty and has engaged in restorative justice. The sentence was suspended on strict conditions, including a €500 payment to Bradley. Both men were intoxicated and there was no prior animosity. The court noted Doyle's early guilty plea during the pandemic.
