The original sentence was six years' imprisonment with the final 18 months suspended. The Court of Appeal, citing an application by the Director of Public Prosecutions, increased the sentence to seven years' imprisonment, finding that the trial judge had erred in suspending part of the term because no exceptional circumstances were identified. The appeal court held that the offence should be viewed at the top of the scale, and the new seven‑year term replaced the original sentence. The case involved a loaded Baikal pistol with a silencer, three bullets in the magazine and one in the chamber, and the firearm's serial number had been removed. Daniel Prenderville pleaded guilty.
