Summary

John O'Sullivan, a 59‑year‑old father of six, pleaded guilty in Dublin Circuit Criminal Court to knowingly filing an incorrect 2007 tax return and evading €100,000 in tax, as well as to failing to file returns for 2009, 2010 and 2011. He admitted nine prior convictions for failing to file returns. The total tax liability, including back taxes and capital gains tax, was €299,658, which he has fully repaid. Judge John Aylmer, after considering mitigating factors such as the economic downturn of 2008, the guilty plea and repayment, sentenced O'Sullivan to 18 months imprisonment, but suspended the sentence entirely on strict conditions, requiring him to keep the peace and be of good behaviour for 12 months. The case was prosecuted by Diarmuid Collins BL on behalf of Revenue, and defended by John Fitzgerald SC.
