Armed robber's conviction for shooting two pizza restaurant staff is upheld

Summary

In a case heard at the Dublin Circuit Criminal Court, Joseph Behan, aged 45, was convicted of robbery, attempted robbery, assault causing serious harm, assault causing harm, possession of a firearm and reckless discharging of a firearm after a raid on Mizzoni's Pizza in Edenmore Shopping Centre on New Year's Day 2019. The jury found that Behan entered the takeaway with a gun, demanded money while staff toasted the New Year, and when a staff member threw a champagne bottle at him, he fled but fired several shots into the kitchen. Two staff members were shot, one sustaining a through‑and‑through chest wound that put him at serious risk of death. Judge Martin Nolan sentenced Behan to 15 years' imprisonment for assault causing harm. Behan's appeal to the Court of Appeal was dismissed, with the court upholding the conviction and sentence.
