Summary

A 38‑year‑old man from Cork was sentenced to four years' imprisonment after being convicted of raping his younger sister when she was aged between eight and ten and of sexually assaulting her again when she was 16. The offences took place in the family home, the first between 25 November 1995 and 17 January 1998, the second between 19 March 2004 and 23 November 2004. He pleaded not guilty to both charges. The victim, who was asleep on a couch when the second assault occurred, testified that her brother removed her clothes and assaulted her, and that her older sister intervened and took her to another house. In her impact statement she described the trauma and shame she felt, and how coming forward has relieved her of the burden. The court noted the breach of trust and the victim's youth as aggravating factors, and the defendant's age at the time of the offences as mitigating.
