Immigration expert gives evidence in Adrian Donohoe trial
Summary
The trial of Aaron Brady, 29, from Crossmaglen, Co Armagh, continued before Mr Justice Michael White and a jury. Mr Brady has pleaded not guilty to the alleged capital murder of Det Gda Adrian Donohoe, who was on active duty, and the alleged robbery of approximately €7,000 in cash and cheques, both occurring on January 25, 2013, at Lordship Credit Union, Bellurgan, Co Louth. US immigration expert Kerry Bretz testified that it is "very unusual" for Homeland Security to take no action against a visa overstayer. He stated that while Homeland Security has discretion, it is "highly unlikely" they would release a detained overstayer to file an application later, a practice he has never encountered in nearly 30 years. The expert noted that officers often use immigration violations as "leverage" to secure cooperation from vulnerable individuals. Prosecution counsel Brendan Grehan SC suggested that Homeland Security's assistance to An Garda Síochána in the murder investigation provided ample reason for such discretion. Mr Bretz acknowledged this was possible. The defence evidence continues tomorrow.
