Delaney joined as notice party to ODCE application

Summary

Former FAI CEO John Delaney has been joined as a notice party to proceedings brought by the Office of the Director of Corporate Enforcement (ODCE) concerning materials seized from the FAI's offices. The ODCE applied to the High Court to determine if the seized documents are legally privileged, which would prevent their use in its ongoing investigation into certain matters concerning the FAI. The application was heard before Ms Justice Leonie Reynolds, who was informed by Jack Tchrakian BL that Mr Delaney wished to be joined as a notice party. The ODCE's application, made under the 2014 Companies Act, follows a search warrant executed on February 14th. In a related ruling last year, the court found that specific passages in documents provided by the FAI and Deloitte Ireland LLP contained legally privileged material that could not be used in the investigation.
