ODCE wants High Court to rule if Delaney documents are privileged

Summary

The Office of the Director of Corporate Enforcement (ODCE) has applied to the High Court to decide whether documents seized from the Football Association of Ireland (FAI) under a search warrant are legally privileged. The seized papers relate to former FAI chief executive John Delaney. Elva Duffy, counsel for the ODCE, filed the application under sections of the 2014 Companies Act on an ex‑parte basis. The High Court judge, who noted that the documents might contain private matters concerning Mr Delaney, adjourned the case to later in the week and suggested that Mr Delaney be made a notice party. The decision will determine if the documents can be used in the ODCE's ongoing investigation into the FAI. The matter follows earlier rulings by Justice Leonie Reynolds, who found that extracts from FAI documents and those provided by Deloitte Ireland were protected by professional legal privilege and must be redacted from the investigation.
