Rapist returned to prison for committing burglaries after release

Summary

In 2011 Gerard Kane, aged 43, broke into a woman's home and raped her twice. He had been on bail for a separate burglary of a Fianna Fáil minister's office. In November 2012 he pleaded guilty to the rape and was sentenced to twelve years with three years suspended. Released in August 2018, he committed two burglaries in January 2019, for which he received a three‑and‑a‑half‑year sentence with the final year suspended. The court activated one year of the suspended portion of the 2012 sentence, crediting time already served, and ordered it to run consecutively with the 2019 sentence. Kane's defence cited mental health issues, homelessness, lack of support and self‑medication as factors contributing to his reoffending. The court noted the victim's severe trauma and the defendant's chaotic background. The case remains at the sentencing stage.
