Summary

Vincent Banks, a convicted member of the IRA, has lost his appeal against his conviction. Banks, 49, of Dublin 7, was found guilty by the Special Criminal Court of membership of an unlawful organisation. He was sentenced to five years' imprisonment in October 2017 for purchasing a Toyota Camry linked to the 2012 murder of prison officer David Black. Although Banks was previously acquitted of withholding information regarding the killing, the court found he acted as a trusted member of the organisation to obtain the vehicle used in the crime. In the Court of Appeal, Banks challenged the admissibility of his garda interviews, arguing that inferences drawn from his silence were not properly explained. He also contested the lawfulness of his arrest and the handling of belief evidence. Mr Justice John Edwards, sitting with President George Birmingham and Ms Justice Marie Baker, dismissed these arguments. The court ruled that Banks had adequate legal advice and that the Special Criminal Court correctly applied the law regarding his arrest. The judges noted that arguments concerning belief evidence had been repeatedly litigated and found no basis to overturn the lower court's decision. Consequently, the appeal was dismissed, and Banks' conviction stands.
