Insurers have failed to make decision over recycling plant fire, businessmen claim

The fast‑track Commercial Court has admitted a dispute in which businessmen Frank and John Gargan and Rathcoole Grain Ltd claim that QIC Europe Ltd failed to decide whether to pay out on an insurance policy covering fire damage to a recycling facility in South County Dublin. The plaintiffs say they leased premises to Natural Energy & Recycling Ltd at Tay Lane, Greenogue, which suffered extensive fire damage on 21 August 2018, costing an estimated €1.3 million to restore. They had an insurance policy with QIC from 2017 and notified the insurer the day after the fire. The plaintiffs allege that QIC has refused, neglected and failed to indemnify them, and that the insurer has only said it is "finalising its investigations."
