Counsel for the defendant questioned the lack of colour photos and the absence of damage to Mr Delaney's car in a picture taken by the defendant. Mr Delaney denied exaggerating his injuries and stated his condition was not normal prior to the incident. After cross-examination, the parties entered into talks and the matter was settled, with the case struck out with the consent of both parties.
