Rapist to be released despite allegation he has not met conditions
Summary
In 2013 a 58‑year‑old man broke into his ex‑partner's home in Cork, armed with a hatchet, and raped her for five hours, threatening to kill her and cutting her hair with scissors. He initially denied the attack but later pleaded guilty. In October 2013 Mr Justice Garrett Sheehan sentenced him to ten years, suspending the last three on the condition of good behaviour for ten years and participation in the "Better Lives" sex‑offender treatment programme. The man has no prior convictions. The DPP applied to the Central Criminal Court to revoke the suspension, arguing he had not fully engaged in the programme. A senior probation officer reported that the offender denied many aspects of his conduct and had not progressed sufficiently in offence disclosure work. Mr Justice Paul McDermott noted the offender had cleared the first stage of the programme but struggled at the next level.
