The prosecution contends that after the crash, occupants of the Audi, including an allegedly injured driver, exited the vehicle and entered a third car, a Volkswagen, which was later seen at the hospital. Mr Jones was subsequently admitted to the same facility with leg injuries. Mr Jones has pleaded not guilty to the charge. In his opening address, counsel Dominic McGinn SC stated that the State must prove beyond reasonable doubt that Mr Jones was the driver, that his driving was dangerous, and that it caused Mr Qu's death. The trial is presided over by Judge Patricia Ryan and a jury of eight men and four women. The matter is currently ongoing and is expected to run for eight days, with proceedings continuing on Monday next.
