Summary

In the Central Criminal Court, a jury is deliberating the case of Tomas Gajowniczek, 37, who denies attempting to murder his partner, Alicja Kalinowska, 30, by suffocating her with underwear and beating her with a hammer. Mr Justice Patrick McCarthy explained that the jury has three possible verdicts: guilty, not guilty, or not guilty by reason of insanity. He instructed the jury to first decide whether Gajowniczek assaulted Kalinowska with intent to kill, and if so, whether he was mentally disordered at the time of the alleged offence. The defence must prove their case on the balance of probabilities. Kalinowska testified that Gajowniczek punched her, stuffed underwear in her mouth, held her nose, beat her with a hammer, and poured a drink down her throat until she passed out.
