They had filed motions to strike the claim as frivolous and to appoint a liquidator to investigate Octagon, but W2 opposed these motions. After negotiations, the parties agreed to dismiss the motions to dismiss the case and to wind up the firm, and to allow W2 to pursue Octagon's claims against the defendants. The judge approved the settlement and the case was adjourned until April 2018.
