Pair admit to "odious" illegal dumping
Summary
Patrick Murphy and Gavrila Puscas were sentenced at Dublin Circuit Criminal Court after pleading guilty to illegally dumping two skip-loads of mixed waste at a vacant site in Santry on the night of May 14/15, 2015. Judge Petria McDonnell described the act as "odious" and a "blight on the landscape." She sentenced Murphy to nine months suspended and Puscas to six months suspended, both for a period of 12 months, with conditions to keep the peace and be of good behaviour. The judge indicated she would have imposed tougher sentences had she not been constrained by the one-year suspended sentence previously imposed on their employer, Wayne O'Hare, in April. O'Hare, the former director of W K Waste Ltd, was sentenced by Judge Patricia Ryan. The court heard that Murphy, on a JobBridge scheme, and Puscas, a new driver, were directed by O'Hare to dump the waste. Gardaí arrested the men after surveillance by a Dublin City Council officer tracked the truck. Both defendants have no previous convictions. Defending counsel highlighted Murphy's intention to impress his boss and Puscas's limited industry knowledge. The illegally dumped waste was removed six weeks later. W K Waste Ltd has since gone into liquidation.
