The items were allegedly recovered by gardai on a Dublin‑to‑Belfast train at Connolly Station on 19 July. At a brief hearing on 1 November, the Director of Public Prosecutions applied under Section 49 of the Offences Against the State Act for Murtagh to be tried before the Special Criminal Court. Judge Tony Hunt, with Judges Patricia Ryan and James Faughnan, granted the order.
