Marques had been in custody since August 2013 and had previously challenged the High Court's 2015 order for his surrender, with the Court of Appeal dismissing his appeal. He also sued the Director of Public Prosecutions for not prosecuting him in Ireland, offering a guilty plea, but both the High Court and Court of Appeal rejected his actions. The Supreme Court declined his appeal on that matter, and an application to the European Court of Human Rights failed.
