The High Court has ruled that specific property assets are not held in trust for the Summerville Partnership, dismissing claims by Emma Joyce, the partnership's managing partner. The applicant, along with Summerville House and Rosbeg Westport, sought declarations that assets in Ireland and London were held for the benefit of the Joyce children, taking precedence over AIB's rights. Although Cherry Cottage was found to be a partnership asset, AIB was entitled to security on it. The judge adjourned the matter to allow both sides to consider the judgment, with final orders to be made when the case next returns to court.
