A military court at the Military Justice Centre in McKee Barracks, Dublin, has begun deliberations in the trial of Sergeant Martin Dougan, who is accused of assaulting Corporal Niall McShane. The alleged incident occurred on 9 March 2014 in a pub in Naqoura, Lebanon, while both men were serving with the Irish Defence Forces. Sgt Dougan, represented by Gerard Humphreys BL and Patricia McKenna BL, pleaded not guilty to the charges. The prosecution, led by Colonel Gerry Lane, argued that the board could trust Cpl McShane's evidence, noting that his memory of the assault was recovered after sessions with a Defence Forces psychologist, despite the complaint being made a year later. In closing remarks, the defence counsel highlighted gaps in the prosecution's case, asserting that reasonable doubt remained regarding whether Sgt Dougan was the assailant. A separate charge alleging Sgt Dougan was under the influence of an intoxicant was previously thrown out by military judge Colonel Michael Campion due to a lack of evidence. The board of officers is now set to determine the outcome of the trial.
