Court dismisses charge of false imprisonment against Limerick man

Summary

In a Special Criminal Court hearing on 31 March 2017, the charge of false imprisonment against Mark Heffernan, aged 32, was dismissed. Heffernan had been accused of participating in a nail‑gun assault on Dan Quilligan, a 53‑year‑old resident of Rathkeale, who was beaten and had a nail driven into his left foot in a Limerick house. Heffernan denied imprisoning Quilligan at 6 Larch Court on 14 September 2015 and pleaded not guilty to the assault. Judge Tony Hunt ruled that any evidence of false imprisonment was integral to the assault and should be dealt with under the assault charge. He also excluded part of protected witness Tom Lillis's testimony, stating it did not meet the standard for a jury conviction. The case will resume on Monday with Judges John O'Hagan and Ann Ryan present.
