Jail for man who made menacing phone calls to innocent stranger

Summary

Patrick Clarke, aged 31, was sentenced to three and a half years' imprisonment for making two menacing phone calls to Paul Gilmartin, demanding €60,000. The Dublin Circuit Criminal Court found Clarke guilty of making an unwarranted demand with menace on 10 May 2012 and again on a later date. The judge, Gerard Griffin, suspended the final 18 months of the sentence for two years on strict conditions. Clarke was arrested after a call was traced to an anonymous SIM card he had bought. He denied that he intended to harm Gilmartin, claiming he had no intention of violence and received no payment for the calls. Gilmartin had been subjected to sustained nuisance calls and threatening texts before and after Clarke's calls. Clarke's defence argued that Gilmartin was an innocent victim of the abuse.
