Gardai warned murder accused that inferences could be drawn
Summary
In a Central Criminal Court hearing, Gardaí warned 57‑year‑old Arnis Labunskis, accused of murdering his flatmate Dainius Burba, that a judge and jury could draw inferences if he failed to disclose any facts he intended to rely on in his defence. Labunskis, who lives on Wolfe Tone Street, Limerick, was found to have discovered Burba's body in their unlocked flat on 21 or 22 April 2015. He had previously pleaded not guilty to the murder of the 39‑year‑old Lithuanian father of two. Detective Sergeant Brian O'Connor, who interviewed Labunskis multiple times after the discovery, warned him that any omission could be used against him. Labunskis replied that he had nothing to say. The trial, presided over by Ms Justice Deirdre McCarthy with a jury of three women and nine men, will resume this afternoon.
