Man at "forefront" of attack on security staff loses appeal
Summary
Mark Carlyle, 27, of Derry Park, Crumlin, Dublin 12, pleaded guilty to violent disorder outside a Harcourt Street nightclub on 23 September 2014 after being refused entry. He was sentenced by the Dublin Circuit Criminal Court to five years' imprisonment, with the final 18 months suspended, on 15 December 2015. Carlyle's appeal against the severity of the sentence was dismissed by the Court of Appeal on 10 October 2016. Mr Justice Alan Mahon, sitting with Mr Justice Garrett Sheehan and Mr Justice John Edwards, upheld the sentence as a "substantial sentence" justified by the circumstances. The Court noted that Carlyle had initiated a violent altercation with security staff, pulling one member away from colleagues and punching him eight or nine times, and had thrown a security barrier in a crowded area.
