Rape accused told gardaí he had "sleep-walking history"

Summary

A 29‑year‑old man accused of raping a female friend in Dublin on 28 September 2008 pleaded not guilty at the Central Criminal Court. In an interview with Gardaí he admitted to having a history of sleep‑walking and claimed he may have had sex with the woman while asleep, saying he does not remember the incident. He described being in a semi‑conscious state and asserted he would never have unprotected sex. He also admitted to sleeping with other friends and kissing other girls in his sleep, and that he and the complainant were close friends but not a couple. He told Gardaí that on the night of the alleged rape he woke up with the complainant asking if he was wearing a condom. The trial is before Mr Justice Patrick McCarthy and a jury of eight men and four women.
